Terms of use
The terms for using this site and its results: what the results are and are not, how you may use and quote them, and the legal terms that apply.
Last updated: October 19, 2026
About these terms
These terms of use (the "Terms") govern your use of pickbench.ai, the results and data published on it, and its endpoints for AI agents (together, the "Site"). The Site is operated by Pickbench (the operator; its legal entity details will be published on this page; "Pickbench", "we", "us"). By using the Site you agree to these Terms. If you do not agree, do not use the Site. These Terms take effect when they are published on this page; their effective date and the operator's legal name, entity type and state of formation will be stated here.
These Terms are written in English. We may provide translations for convenience; if a translation differs from the English text, the English text controls.
Who may use the Site
You must be at least 18 years old to use the Site. If you use it on behalf of an organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.
What our results are
Results are generated by AI models: they describe what named AI models chose through their APIs, under stated conditions, on a stated date. Our software aggregates their choices and shows them in your language through fixed codes; the reasons shown are codes derived from the models' answers, not the models' own words, and no person edits a model's choice. Results are not the behaviour of consumer chat apps or of real shopping agents.
Every share comes with an interval, and each result states its design and what its interval means. The interval of a single question put to a fixed panel describes that panel's agreement under the stated conditions; it is not an estimate for all AI systems, all consumers or a market. Tiers are not strict ranks, and a position on the chart is only a display order.
Results are research findings, not advice. They are not financial, medical, legal or purchasing advice, not a statement about a product's quality or safety, and not a prediction of sales, traffic or future model behaviour.
We do not measure or publish results for prescription or medical treatments; specific credit, investment and insurance products; firearms; gambling; or political content.
Pages marked Demo data use fictional brands and illustrative, simulated numbers. No AI model was called for them.
Quick battles are estimates you request, made with a smaller measurement design than our official results. They are kept apart from official results and carry a noindex instruction that asks search engines not to index them.
Visitor votes come from an open poll of self-selected visitors of this site. They are not a representative survey, and we do not check whether voters have used or bought the products.
The Consilium helps you compare options against the needs you choose, by showing what named AI models picked. It does not guarantee that a product suits you or is available. Prices are shown with their source and date; check the product details, the price and the terms with the seller before you buy.
In Pickbench Pick Bench (Pick Bench), you pick coded choices (a category, a buyer need, a budget band and, where offered, one optional extra chip; no free text is collected in this version) and compare two anonymous answers from AI models; after you vote or skip, we name the API models, with the conditions and the date the answers were made, and show how many models on the whole panel named each brand. How other visitors voted is not shown yet. The models make the answers through their APIs via OpenRouter, without web search, usually in advance, and we reuse them until the panel changes; for a combination with no saved answer, we may show the answers saved for the closest one. Each answer is shown in one fixed format built from the model's reply (the brands it named, reason codes and, when given, a short product line name), not in the model's full words. AI answers can be wrong or out of date, or name products that are unavailable or do not suit you; check the product details, the price and the terms with the seller before you buy. Pick Bench answers are not purchasing or other advice and not an endorsement by Pickbench or by any model's maker, and no one can pay for an answer, its position or a place on a Pick Bench leaderboard. Pick Bench votes judge which answer gave better advice for the chosen situation; they are not product reviews, and we do not check whether voters have used or bought the products. They are used for aggregate leaderboards of the API models, which we publish only after we have approved their statistical method, labelled as self-selected visitor preference (beta), not a representative survey; they never change the numbers on our brand boards or in the Index. Pick Bench also shows a table of automatic per-model measures (such as answer rate and consistency across repeated answers), computed from the AI models' stored answers to our fixed task set, our task definitions and our reference lists under the stated conditions and date, with intervals. They describe the named API models' answers to this task set under the stated conditions; they do not establish overall model quality, product quality or purchase suitability, and are not a certification or endorsement of any product, brand or model. No one can pay to change them.
Results express our research findings about how the named models responded, under the methodology we publish. Factual details we show, such as prices or specifications, are identified with their source and date. A brand or anyone else who believes a result is wrong can use the corrections policy below.
Nothing here is for sale
No one can pay for a result, a rank, a tier, inclusion or exclusion, verified status or placement, and no fee depends on what a public result shows. Our paid services promise measurement, never a rank, a placement or more traffic.
Services for businesses
Category reports, data subscriptions, agency plans, custom research and other paid services for businesses are provided under a separate written agreement, which governs them. If that agreement conflicts with these Terms, the agreement controls for those services. These Terms govern the public Site.
Acceptable use
When you use the Site, you agree not to:
- manipulate votes: vote more than once on a battle or a Pick Bench question through extra devices, accounts, cleared cookies, scripts or organised campaigns, or buy, sell or trade votes;
- request Pick Bench rounds by automated means or collect Pick Bench answers in bulk;
- get around our rate limits or quotas, access the Site by automated means in a way that overloads it, or interfere with the Site, its API or its agent endpoints;
- enter other people's personal information, including the name of a private person as a brand, or text meant to instruct or trick our systems or AI models, in any field;
- pretend to be a brand or a person you are not;
- present our results in a misleading way, as described in Quoting and citing our results;
- use the Site to break the law or to infringe anyone's rights.
We may refuse requests from, limit or block a client or network that breaks these rules, and remove content that breaks them. If we restrict something of yours, you can write to legal@pickbench.ai to ask why.
Quoting and citing our results
You may quote, cite and share our published results, including in news, research and advertising, if you keep them accurate: give the date, the named models (or a link to the result page that names them), the conditions and the interval, keep any Demo data label, and do not present a result as a consumer app's choice, as a survey of people, as a strict rank, or as an endorsement by Pickbench or by any model vendor.
If you are, or work for, a paying customer of ours and you cite a result about your own brand, disclose that relationship next to the citation.
Do not use the Pickbench name or logo as a badge, seal or certification unless we have licensed it to you in writing.
Your responsibility for your use
If you use our results in advertising or other commercial communications, you are responsible for that use, including compliance with the advertising, comparative-advertising and consumer-protection laws that apply to you. You agree to defend, indemnify and hold harmless Pickbench and its directors, officers, employees, contractors, affiliates and agents from any claims, losses, liabilities and costs (including reasonable attorneys' fees) arising from your misuse of our results or your breach of these Terms.
Data licence and our content
Our published datasets (the results, shares, intervals and tiers, and the signed snapshots and metadata we publish with them) are licensed under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). You may copy, share and adapt them for any purpose, including commercially, if you credit "Pickbench (pickbench.ai)" with the result date and, where practical, a link, say whether you changed them, and do not suggest that we endorse you or your use. Facts and methods are not protected by copyright in any case.
Everything else on the Site, including its text, design, code, logos and the Pickbench name, is © Pickbench. All rights reserved, except where a page says otherwise.
Third-party material keeps its owners' rights and licences and is not covered by the CC BY licence: brand names and trademarks, prices and product details from other sources, fonts and open-source components.
The site's typefaces, Literata and Golos Text, are used under the SIL Open Font License.
Brand names and trademarks
Brand and product names are trademarks of their owners. We use them only to identify the brands and products we measured. Their use implies no endorsement, sponsorship or relationship.
Copyright complaints
If you believe material on the Site infringes your copyright, write to the address in the Contact section of this page with the information listed in 17 U.S.C. § 512(c)(3). We may remove the material and, where appropriate, block repeat infringers. A designated DMCA agent will be named here once registered with the US Copyright Office.
Reporting content
Quick battle pages are made at a visitor's request and can show the brand names that visitor entered. Pick Bench answers are written by AI models from our own prompts and can show brand or product line names a model named. If a page shows something you believe is illegal or abusive, write to legal@pickbench.ai with the page address and the reason. We aim to review each report promptly, and we may remove what breaks the law or these Terms.
Corrections and right of reply
This corrections policy is part of these Terms. It applies in the same way to every brand, whether or not it is a customer, and to anyone else who reports an error.
How to ask: write to legal@pickbench.ai with the address of the result, what you believe is wrong, and the evidence. You may send confidential supporting information; we use it only to review your request and do not publish it.
Our standard: if we made an error, we correct it, whatever the evidence that showed it. A change to the product facts a measurement uses (such as specifications or prices) needs public, verifiable evidence, because our results use only public information.
Public log: every correction is listed on our corrections page with its date, what changed and why, and the affected result pages link to it. We never quietly change a published result.
Brand statement: a brand named in a result may ask us to publish a short statement with that result. By sending a statement you allow us to publish it with the result. We publish it unless it is unlawful, misleading or abusive, or contains personal information, links or instructions aimed at AI systems; we may shorten it and will say so.
Timing: we aim to acknowledge requests promptly and to decide them within a reasonable time; complex cases can take longer, and we will tell you if they do.
Payment never affects this. Paying customers and other brands follow the same process and meet the same evidence standard, and no correction or statement is for sale.
Requests about your own personal information are handled under our privacy policy and never depend on publishing evidence about you.
No warranties
THE SITE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT. We aim to keep results correct, signed and available, but we do not promise that the Site or any result is complete, error-free, current or always available.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PICKBENCH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN TOLD THEY ARE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
Some jurisdictions do not allow certain warranty exclusions or limits of liability, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
Governing law and disputes
These Terms and any dispute arising from them or from the Site are governed by the laws of the United States and of the US state in which the operator is established; that state and the courts for disputes will be named on this page. Either of us may bring an individual claim in a small-claims court that has jurisdiction.
General
These Terms, with the policies they refer to, are the entire agreement between you and us about the public Site. If a court finds part of them unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. We may assign these Terms as part of a merger, acquisition or sale of our business; you may not assign them without our written consent.
Changes
We may change these Terms. We post the new version here with its effective date, and the list under Changes says what changed. Changes apply from that date; if you keep using the Site after it, you accept the new Terms.
- October 17, 2026: final text published. Earlier versions were never in effect.
- October 19, 2026: added Pick Bench: what its answers are and are not, how votes are used, and the acceptable-use and content-reporting rules that cover it.
